Specialists of FAS and India Competition Commission discussed interaction in the field of cartel investigation
The parties are interested in building up cooperation, particularly, in investigating and suppressing cartels
Head of FAS Anti-Cartel Department Andrey Tenishev had a meeting with a cooperation advisor of India Competition Commission, Ms. Jyoti Jingdar.
One of the main items on the agenda was cartelization of the pharmaceutical sector. Head of FAS Anti-Cartel Department discussed a large-scale investigation in this area in the Russian Federation.
He gave examples of recently investigated cartel cases, including, in particular, the case against “Jodas Expoim” Ltd. “Pharakoppola” Ltd. and “SaTiKom” Ltd. (the first company was founded by Indian businessmen). Andrey Tenischev pointed out that it admitted violating the antimonopoly law to FAS and took advantage of the leniency programme.
Ms. Jyoti Jingdar emphasized that a similar programme is widely employed in India as an efficient investigation tool for investigating and suppressing violations.
Andrey Tenishev pointed out: “In spite of significant number of FAS investigations on the pharmaceutical market and the volumes of drug supplies by Indian manufacturers to Russia, Indian companies have not come in sight of the antimonopoly authority so far, which confirm good conduct of Indian business on the Russian market”.
He informed his Indian colleagues about the signs of cartels and the methods of exposing them by Russian competition authority. In the experience of Andrey Tenishev, “electronic tenders allow to prove cartels on-line from any point in the country”.
Finally, the parties expressed mutual interest in continuing bilateral cooperation. Andrey Tenishev invited the Indian colleagues to take part in experience exchange events.
