FAS: SINGLE SUPPLIERS OF MEDICINES AND MEDICAL PRODUCTS HAVE PARTIALLY SWITCHED FROM LAW NO. 223-FZ TO THE LAW NO. 44-FZ

At the end of the transition period, from July 1, 2024, such purchases from a single supplier will be carried out exclusively under Law No. 44-FZ

The President of the Russian Federation signed the relevant law.

Thus, currently, such suppliers as SUE Tattehmedpharm, SE of the Nizhny Novgorod District "Nizhny Novgorod Regional Pharmacy",
SUE "BRYANSKFARMATSIYA" and others are required to apply the provisions of the Law No. 44-FZ when conducting their own purchases. This applies to the requirements for the formation of lots*, the provision of advantages to domestic goods**, as well as the rules for describing the object of purchase***.

From July 1, 2024, single suppliers will have to be completely guided by the
Law No. 44-FZ. In addition, customers will be required to send a notification of such a purchase to the regional office of FAS Russia, as well as include a justification for its price in the contract.

At the same time, the document amends the Law No. 44-FZ to expand the list of cases of purchase from a single supplier. Customers of the regions will be able to buy from a single supplier medicines, specialized therapeutic food and medical products, consumables, disinfectants, as well as services for storage and delivery of relevant goods, repair and maintenance of medical facilities.

The only supplier may be a regional state unitary enterprise or a joint stock company, 100% shares of which are owned by the region.

The decision will maintain the existing system of medical support in some regions of the country and will increase the transparency of procurement, competition, as well as provide support to Russian entrepreneurs.
