COURT UPHELD FAS IN CASE OF PULKOVO AIRPORT
Earlier, the main airport operator violated the Rules for Providing Access to the Services of Natural Monopolies at Airports (1)
Pobeda Handling LLC (2) (the authorized operator of Pobeda Airlines LLC) applied to VVSS LLC (the main operator of Pulkovo Airport) with an application for access to the airport infrastructure for passenger service of the airline, in particular, on providing access to check-in counters, weighing and baggage handling, as well as boarding gates.
Contrary to the rules (3), the airport did not respond to the twice-sent request of Pobeda Handling. In addition, there were no results of reviewing applications and confirming or rejecting them.
The FAS Russia found a violation in the actions of the main airport operator and initiated an administrative case (4). According to the results of its review, the Authority imposed a fine on VVSS LLC.
FAS notes that it is unacceptable to create conditions that put a consumer or several consumers in an unequal position when accessing infrastructure facilities and services at airports.
The main operator of the airport tried to challenge the decision and fine of the Authority, but Moscow Arbitration Court supported the position of the FAS Russia.
