FAS issued a warning to “Apple Rus” Ltd.
By 1 May 2017 the company should open a unified service centre in the Russian Federation
On 20 February 2017, the FAS Commission investigated a case against “Apple Rus” Ltd.
According to a statement received by FAS, in 2016 service centres failed to replace a damaged display on Apple iPhone 6 Plus smartphone for a physical person due to absence of supplies of the above spare parts to Russia, and suggested that the smartphone owner could have a replacement making an additional payment.
The antimonopoly authority established that the actions by “Apple Rus” Ltd. – the only supplier of the products of “Apple inc” in Russia had elements of violating Part 1 Article 10 of the Federal Law “On Protection of Competition” - failure to provide a possibility to use products of “Apple inc” (iPhone 6, iPhone 6 Plus, iPhone 6s, iPhone 6s Plus) during their life period.
Company representatives petitioned to consider a case against “Apple Rus” Ltd. upon signs of violating the antimonopoly law under Clause 5 Part 1 Article 10 of the Federal Law “On Protection of Competition”, that provides for issuing warnings to eliminate signs of violating the antimonopoly law.
FAS granted a petition of “Apple Rus” Ltd. and additionally qualified the case under the above norm of the Federal Law “On Protection of Competition” with issuing a relevant warning to be executed by 1 May 2017 and postponing the case investigation under 5 Part 1 Article 10 to a later stage.
