FAS opened a case against the Ministry of Healthcare of the Russian Federation
The case upon signs of violating Part 1 Article 15 of the Federal Law “On Protection of Competition” is opened following the failure to execute a warning of the Federal Antimonopoly Service (FAS Russia).
To execute the warning, by November 2016 the Ministry of Healthcare of the Russian Federation was supposed to set the requirements on organizing and performing works (services) for the licensing purposes under Clause 3 of the Regulations on licensing medical activity, approved with No.291 Decree of the Government of the Russian Federation.
Deputy Head of FAS Andrey Kashevarov emphasized: “Due to the failure to execute Clause 3 of the Regulations on licensing medical activity by the Ministry of Healthcare, today the Russian Federation lacks a single system of licensing requirements to license applicants and licensees, involved in particular types of works and services that form medical activities, which puts medical organizations in an unequal position getting licenses”.
The case regarding the actions of the Ministry of Healthcarewill be heard on 16 March 2017.
